In consideration of my participation or my minor child’s participation in Hawaii Synchro Camp or Hawaii Synchro & Yoga Retreat activities and events with Way of Light Yoga Retreats LLC on the dates, June 8-12, 2022, June 15-19, 2022, June 23-27, 2022, July 11-15, 2022, July 18-22, 2022 I agree as follows:

Booking Your booking is not considered definite and no contract will exist until Way of Light Yoga Retreats LLC receives the deposit from you and you agree to these terms and conditions.
Payment The price of the retreat is $1,500 US Dollars. Registration requires acceptance of your waiver, registration form, and a deposit of $750 or full payment of $1,500. The remaining $750 is to be received on or before March 1st, 2022 to Way of Light Yoga Retreats LLC to complete the booking. The 2021 Holiday Price or Sibling Discount is $1,400, and can be paid in full or split into a deposit of $650 and final payment of $750 on or before March 1st, 2022.
Your Travel Arrangements All flight travel arrangements to Kona, Hawaii are your responsibility and at your own cost. The Released shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.
Travel Insurance Travel insurance is highly recommended. If you choose to buy insurance, it is recommended that it cover the Activities of this retreat as well as unexpected cancellation, sickness, COVID positive test, losses and all the usual risks. You should bring the policy with you in case of an emergency.
Your Health

(a) It is your responsibility to let your Coach/Yoga Instructor know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

(b) I hereby certify that I am physically fit for participation in the camp and retreat and have not been advised otherwise by a qualified medical person. I understand it is my responsibility to consult a doctor with an understanding of yoga and synchronized swimming to check that I am sufficiently fit and healthy to undertake yoga classes and synchronized swimming that I may choose to do whilst on the retreat. I hereby assume all the risks of participation in the Activities of the Camp and Retreat, including without limitation all the Risks, whether such risks are caused by the negligence of carelessness of or from dangerous or defective equipment or property owned or provided in any way by the Released. I acknowledge that the Camp and Retreat carries the potential for serious injury, property loss, and even death. In the event medical treatment is provided to me or my child or legal guardian, I hereby consent to such care.

(c) Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats.

(d) Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and the Released shall not be responsible for any injuries caused by uneven terrain.

(e) “Activities” include all activities at the camp and retreat shall include without limitation yoga, acro yoga, synchronized swimming, boating, swimming in the ocean or other natural bodies of water, hiking, hot tubbing, dancing, and riding in transportation van vehicles. The Released is not liable for any injuries you may incur. Yoga, Acro Yoga, and Synchronized Swimming classes are undertaken at your own risk. The Released is not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. “Risks” include without limitation vehicular traffic, road conditions, health and environmental conditions (including without limitation disease, infection and animals), weather, driver error, weather error, food provided at the facility, actions of other people, actions of the Released. “Released” shall include Way of Light Yoga Retreats LLC and its employees, contractors, and equipment.

(f) Women who are pregnant should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide. Pregnant women must have done yoga before they arrive.

Cancellation by the Participant

(a) You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us.

(b) If you cancel before February 28, 2022, Way of Light Yoga Retreats LLC will retain an administrative fee of $250 for the booking and organizing of your reservation. If you cancel after March 1, 2022, $750 is refundable from the full payment .

(c) Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat if you cannot attend or leave early. If the reason for cancellation is covered under the terms of your Travel Insurance Policy, you may be able to make a claim on your insurance.

Amendments by the Released Occasionally, changes may have to be made (e.g., yoga teacher, class times or other arrangements), which we reserve the right to do at any time. Due to COVID-19 all advertised activities such as pool time are not guaranteed.
Cancellation or Postponement by the Released. We reserve the right in any circumstance to cancel or postpone the retreat. Participants can either hold their spot for the future event, or cancel and receive a $750 refund. The Released is not responsible for the participants airfare.
The Liability to the Participant

(a) Way of Light Yoga Retreats LLC accepts responsibility for ensuring that the retreats are supplied as described and that the services are to a reasonable standard.

(b) Way of Light Yoga Retreats LLC does not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, global pandemic, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances, acts of God, or other events beyond our control.

No Liability for Possessions It is your responsibility to ensure that your possessions are kept safe at all times. The cabins have the option to be locked and you may only enter with a pin code.
Complaints If you have a problem during your retreat, please inform the organizer immediately and he/she will endeavor to put things right. Please note that the Released cannot be responsible for the individual behavior of any group member or other guest sharing your accommodation. There are 5 to 6 individuals who will share a cabin and bathroom.
Privacy Policy Way of Light Yoga Retreats LLC does not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of Way of Light Yoga Retreats LLC.
Photography I understand that during a Retreat I may be photographed, videotaped and or my words may be recorded and I authorize and allow Way of Light Yoga Retreats LLC and its retreat facilitators to use such images, words and likenesses for marketing, on websites, in brochures or other writings and any other legitimate purpose. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product.
Waiver, Release and Agreement Not to Sue I, and on behalf of my executors, administrators, heirs, successors and assigns, hereby fully release, waive any claims I or they may have against, discharge and agree not to sue the Released or each of them from any and all liability to me or my executor, administrator, heirs, successors and assigns for any and all damage, injury or death of myself or the participant while at, participating in, while en route to or from a Retreat or while participating in the Retreat or any Activities, whether caused by negligence or carelessness of the Released or otherwise.

15. Indemnification of Hold Harmless I, both on my own behalf and as the parent or legal guardian of a participant of a Retreat, hereby agree to indemnify and hold harmless the Released and each of them from any loss, liability or damage, including reasonable attorney’s fees incurred in any suit, demand or legal action arising out of any alleged injury, damage or death resulting from engaging in any Activities or participation in any Retreat, whether such injury damage, death is alleged to or did result from the negligence or carelessness of any person.
